Saved Structure Plan Policies

The 2004 Planning and Compulsory Purchase Act has taken away the County Council’s responsibility to prepare and implement a Structure Plan. However, under the terms of the 2004 Act, Structure Plans have been “saved” for a period of up to 3 years from commencement of the Act and have thus remained part of the Development Plan.

This three year period came to an end on 28 September 2007. Therefore the Structure Plan as a whole ceased to have effect as a Development Plan from the above date. However, under the 2004 Act the Regional Planning Body (RPB) is able to recommend to the Secretary of State, following discussion with the Structure Plan Authority, whether any individual policies in a Structure Plan should be “saved” beyond the 3 year transitional period in order to avoid the possibility of a policy void.

The above exercise has been undertaken and the Secretary of State (September 2007) has issued a “direction” (under Paragraph 1(3) of Schedule 8 of the 2004 Act) setting out those policies to be “saved” in the Norfolk Structure Plan beyond the transitional 3 year period. These included the following ten policies: Policies: CS.5; EC.; EC.10; ENV.5; ENV.14; T.2; T.12; T.17; RC.8; AND ENV.3.

In May 2008 the Go-Office for the East of England published the final version of the East of England Plan. As consequence of the publication of the Plan a number of the County Council’s previously “saved policies”, have now been replaced by policies set out in the adopted East of England Plan. The only remaining “saved policies” are:

T.17 – Transport General Aviation;

T.2 – Transport New Development

RC.8 – Non Renewable energy

It is envisaged that these remaining saved policies will subsequently be replaced by policies contained in District Council LDF documents.
