Blue badge enforcements

The list below shows recent enforcements brought against individuals for misuse of Blue Badges and/or fraud whilst parking on public roads.  All decisions on enforcement are taken in accordance with the Community and Environmental Services Enforcement Policy.

This information is made available for a limited period in order to promote the openness, transparency and accountability of the criminal justice system to the people it serves.

BBI 19/40 - Section 117 Road Traffic Regulations Act 1984

Officer in charge: Jim Blake

Offence details: Wrongful use of blue badge. Displaying a disabled person's blue badge, to which not entitled and for own benefit, while parking in a disabled person's parking space, Market Place, Swaffham, on  29 May 2019. 

Decision made to prosecute on 8 November 2019.

Recording officer's comments: 

I believe this case can satisfactorily be dealt with as ‘wrongful use’ under Section 117 Road traffic Regulations Act 1984.

Offender was convicted at Norwich Magistrates Court on 4 February 2020. Fined £50 and ordered to pay £30 victim surcharge.

BBI 19/52 - Section 117 Road Traffic Regulations Act 1984

Officer In charge: Jim Blake

Offence details: Wrongful use of blue badge. Displaying a disabled persons blue badge, to which not entitled and for own benefit, while parking in a disabled person's parking space, West Street, Cromer, on 6 July 2019.

Decision made to prosecute on 16 December 2019.

Recording officer's comments: 

I believe this case can satisfactorily be dealt with as ‘wrongful use’ under Section 117 Road Traffic Regulations Act 1984.

Offender was convicted at Norwich Magistrates Court on 4 February 2020. Fined £50 and ordered to pay £32 victim surcharge.

BBI 19/02 - Sec 115 Road Traffic Regulations Act 1984

Officer In Charge: Jim Blake

Offence details: Interference of a Parking Device [extending allowed time period to park on yellow lines] to gain a longer period of parking time, while parked on yellow lines, Nelson Street, Kings Lynn on 5 April 2019.

Decision made to prosecute on 3 October 2019.

Recording Officers comments: "I believe this case can satisfactorily be dealt with under Sec under Sec 115 Road traffic Regulations Act 1984."

Offender was convicted at Kings Lynn Magistrates Court on 24 January 2020. Fined £346.00, ordered to pay £539.59 costs and £34.00 victim surcharge. Total £919.59.

BBI 19/27 - Section 117 Road Traffic Regulations Act 1984

Officer in charge: Jim Blake

Offence details: Wrongful use of blue badge. Displaying a disabled person's blue badge, to which not entitled and for own benefit, while parking on yellow lines, Cremorne Lane, Norwich on 19 April 2019.

Decision made to prosecute on 25 September 2019.

Recording officer's comments: "I believe this case can satisfactorily be dealt with as ‘wrongful use’ under Section 117 Road traffic Regulations Act 1984."
 
Offender was convicted at Norwich Magistrates Court on 3 December 2019. Fined £110.00, ordered to pay £554.65 costs and £30 victim surcharge.

BBI 19/32 - Section 21[4BA] Chronically Sick and Disabled Persons Act 1970

Officer in charge: Jim Blake

Offence details: A person who without reasonable excuse failed to produce a blue badge when required to do so, while parked in a designated disabled person's parking bay, in Church Road, Hoveton, on 1 May 2019. 

Decision made to prosecute on 31 October 2019.

Recording officer's comments: "I believe this case can satisfactorily be dealt with as failure to produce a badge when required to do so under sub section 4BA, section 21 Chronically Sick and Disabled Persons Act 1970."
 
Offender was convicted at Norwich Magistrates court on 3 December 2019. Given a conditional discharge, ordered to pay £250 costs and £20 victim surcharge.

BBI 19/26 - Section 117 Road Traffic Regulations Act 1984

Officer in charge: Jim Blake

Offence details: Wrongful use of blue badge. Displaying a disabled persons blue badge, to which not entitled and for own benefit, while parking on yellow lines, in Greevegate, Hunstanton on 20 March 2019.

Decision made to prosecute on 5 August 2019.

Recording officer's comments: "I believe this case can satisfactorily be dealt with as ‘wrongful use’ under Sec 117 Road traffic Regulations Act 1984. I consider that it is expedient for the promotion of protection of the interests of the inhabitants of the County of Norfolk to institute proceedings against this defendant."

Offender was convicted at King's Lynn Magistrates court on 4 October 2019 Fined £100.00, ordered to pay £300.00 costs and £30.00 victim surcharge.

BBI 19/11 - Sec 117 Road Traffic Regulations Act 1984. 

Officer in charge: Jim Blake
 
Offence details: Wrongful use of blue badge. Displaying a disabled persons blue badge, to which not entitled and for own benefit, while parking in a disabled persons parking bay, in Palmer Road, Gorleston on 6 February 2019. 

Decision made to prosecute on 29 May 2019.

Recording officer's comments: "I believe this case can satisfactorily be dealt with as ‘wrongful use’ under Section 117 Road traffic Regulations Act 1984. I consider that it is expedient for the promotion of protection of the interests of the inhabitants of the County of Norfolk to institute proceedings against this defendant." 

Offender was convicted at Great Yarmouth Magistrates court on 1 August 2019. Fined £500, ordered to pay £274.05 costs and £50 victim surcharge.

BBI 18/97 - Section 117 Road Traffic Regulations Act 1984

Officer in charge: Jim Blake

Offence details:  Wrongful use of blue badge.  Displaying a disabled persons blue badge, to which not entitled and for own benefit, while parking on yellow lines in Cadogan Road, Cromer, on 6 December 2018.

Decision made to prosecute on 18 April 2019

Recording officer's comments:  "I believe this case can satisfactorily be dealt with as ‘wrongful use’ under Section 117 Road traffic Regulations Act 1984."

Offender was convicted at Norwich Magistrates court on 11 July 2019. Fined £40, ordered to pay £30 victim surcharge and £50 costs. Total £120

BBI 18/86 - Section 117 Road Traffic Regulations Act 1984

Officer in charge: Jim Blake

Offence details: Wrongful use of blue badge. Displaying a disabled person's blue badge, to which not entitled and for own benefit, while parking in a disabled person's parking bay, in High Street, Hunstanton on 24 October 2018. Decision made to prosecute on 26 February 2019.

Recording officer's comments: "I believe this case can satisfactorily be dealt with as ‘wrongful use’ under Section 117 Road traffic Regulations Act 1984."

Offender was convicted at King's Lynn Magistrates court on 29 May 2019. Fined £40, ordered to pay £30 victim surcharge.
