Applications for deposits

Applications for Highways Deposits of Statements and Maps and Declarations can be submitted to Norfolk County Council under Section 31(6) Highways Act 1980 and landowner statements under section 15A Commons Act 2006.

Application Requirements

Completion of the  application form for highways deposits CA16 (PDF) [241KB] as prescribed by Schedule 1 to the 2013 Regulations.

The guidance for applicants has been published and should be read in conjunction with the notes at the beginning of form CA16

The form must be signed by every owner (or by their duly authorised representative) of the land to which the application relates who is an individual, and by the secretary or some other duly authorised officer of every owner of land to which the application relates which is a body corporate or an unincorporated association.

The form must be accompanied by an Ordnance map at a scale not less than 1:10,560 (except where the application refers to a map which accompanied a previously deposited statement or declaration with the authority) showing the boundary of the land to which the application relates in coloured edging.

Please note that applicants are not able to deposit a Highways Statement and lodge a Highways Declaration simultaneously in relation to the same land. This is stated in the guidance for applicants from the Department for Environment Food and Rural Affairs (a link to the guidance is provided above). 

Consequently, applications for deposits can be made to lodge a Statement (under part B/part D or both) or to lodge a Declaration under part C with the option to include a Landowner Statement under part D.

Fees

Applications for deposits require a fee to be paid, the fee is applicable for each and every deposit whether you are lodging a Statement or lodging a Declaration. 

The Commons (Registration of Town or Village Greens) and Dedicated Highways (Landowner Statements and Declarations) (England) Regulations 2013 were amended in 2016 to remove the requirement on an authority to post notice of an application to deposit a statement and map, or to lodge a declaration, under section 31(6) of the Highways Act 1980 in an obvious or conspicuous place on the land to which the application relates. Norfolk County Council charge £100.00 for deposits made under section 31(6) of the Highways Act 1980.

However, the requirement to post notice of an application under section 15A(1) of the Commons Act 2006 remains. Norfolk County Council charge £197.50 for the first parcel of land and additional parcels will be charged at £21.25 for each additional parcel.

Acknowledgement of the Application

On receipt of the application, the County Council will check whether the application has been 'duly made'.

An application will be treated as having been 'duly made' if it is;

  • In the form prescribed by Schedule 1 to the 2013 Regulations, or in a form substantially to the same effect with such insertions or omissions as are necessary in any particular case
  • Signed by every owner (or by their duly authorised representative) of the land to which the application relates
  • Accompanied by an Ordnance map at a scale not less than 1:10,560 (except where the application refers to a map which accompanied a previously deposited statement or declaration with the County Council) showing the boundary of the land in coloured edging
  • Accompanied by the correct fee

If the requirements are not met, the application will be returned.

If the requirements have not been complied with then the application will not be 'duly made' and the County Council will be under no obligation either to acknowledge the 'application' or process it further.

If the statement or map in question contains a material error it could invalidate the application, in whole or in part, and any entry made in the register might be removed by the County Council. In this situation the County Council is required to give 28 days notice of the removal.

If the requirements have been complied with then the County Council will:

  • Accept and acknowledge the application
  • Post a notice (if applicable) in an obvious or conspicuous place on each parcel of land
  • Publish the application on the Notices of applications page of our website
  • Send email notifications to every person/organisation who have requested to be informed of applications
  • Ensure that the application is added to the paper register at the offices of Norfolk County Council which is available for viewing
