Why the Building Safety Act is important 

The new Building Safety Act 2022 was passed after the Independent Review relating to the Grenfell Tower tragedy. It is intended to remedy the problems identified by that review and reform building safety.  

How the Building Safety Act 2022 affects your business  

The Building Safety Act amends the Regulatory Reform (Fire Safety Order) 2005 (the FSO). The changes apply to all buildings, not just high-rise and higher-risk residential buildings. 

The changes mainly relate to the duties of responsible persons (RPs) who need to be aware of them and what it means for their role. 

The Building Safety Act applies to all non-domestic premises, which can include: 

  • Places of work 
  • Places where people visit or stay 
  • Non-domestic areas of multi-occupied residential buildings, such as stairways and communal corridors

It does not apply to individual domestic premises. 

Changes to the duties of responsible persons 

The Building Safety Act made significant changes to the duties that RPs must now carry out, relating to recording and sharing information, working with Accountable Persons and other RPs, and the provision of information to residents.

Buildings with two or more sets of domestic premises  

Under the Building Safety Act RPs must now provide additional information to tenants to ensure they feel informed.  

Government guidance to assist RPs understand their new duties 

The government have published helpful guidance to assist RPs in understanding their new duties under the Building Safety Act, which Responsible Persons are urged to read.
